PT VIDIO DOT COM, a company established under the law of the Republic of Indonesia, having its office domicile at SCTV Tower, 14th floor, Senayan City, Jl. Asia Afrika Lot.19, Jakarta 10270, Indonesia (“VIDIO”), having and providing over-the-top service via https://www.vidio.com and/or Vidio application, which is a digital content exhibition platform through the internet, whether subscription-based or free (advertising-based) , and the exhibition is conducted via live streaming or video-on-demand (VOD) on, among others, website, m-sites and mobile application, tv application including other channel distribution owned or incorporated with VIDIO, including other services which served by VIDIO on the Platform.
The definition of VIDIO in this Privacy Policy includes VIDIO affiliates, VIDIO representatives, including but not limited to the financial, insurance, legal, accounting advisors, or other VIDIO advisors providing the professional services to VIDIO, and the third parties entering into cooperation with VIDIO, including but not limited to partners, vendors and subcontractors (as relevant).
All capitalized terms not defined otherwise in this Privacy Policy will have the same meaning as those in the General Terms.
This Privacy Policy applies to any information we collect:
On the websites (mobile and desktop) and Your e-mail communications with us; and
Through applications which may be accessed in all devices, including but not limited to mobile devices and other TV applications with any operating system without limitation.

OBJECTIVE OF PRIVACY POLICY
1.1 This Privacy Policy explains how VIDIO collects, uses, processes and protects the Personal Data of Service Users.
1.2 This Privacy Policy explains the use of information and/or Personal Data provided or collected via Platform, where this Privacy Policy is posted on affiliated or third party sites/platforms that may provide the Platform and/or all features and/or services available on the Platform. VIDIO applies this Privacy Policy in accordance with the prevailing law in Indonesia which isapplicable to VIDIO in delivering Services. VIDIO will send the notification when there is a request for additional personal data for certain features or services.
1.3 TheUsers are expected to be careful because in Platform there are links to other platforms that are not owned or controlled by VIDIO, thereby VIDIO has no responsibility for the User who provides their personal data to such platform. Please always read the Privacy Policy carefully.
USERS’ CONSENT
2.1. By approving this Privacy Policy, the Users hereby provide the explicit consent to the acquisition, storage, use, utilization, processing and/or disclosure of the Personal Data, including the User’s Personal Data, conversations on Services.Users hereby declare that the consent to the personal data and information is carried out without any duress, in competence, and consciousness condition, where the consent is provided by the Users when creating VIDIO’s account and using Services continuously (“User’s Consent”).
2.2. In the event where User provides VIDIO with Personal Data relating to another individual, the User declares and guarantees that User has received consent from the other individual to provide or submit their Personal Data to VIDIO, and thereby approves this Privacy Policy.
2.3. The User is able to withdraw the User’s Consent at any time, by sending the e-mail to VIDIO pursuant to the provision hereunder. VIDIO will review the request and may ask the User to verify the User’s identity using the User's Personal Data collected by VIDIO. Withdrawal of a User's Consent may result in termination of the provision of the Services to the User concerned. VIDIO may decline the withdrawal of User Consent for reasons as required by the related regulations. If an assistance is required to withdraw the User’s Consent previously provided, please contact us by using the information provided at the end of this Privacy Policy.
COLLECTION OF PERSONAL DATA
3.1. “Personal Data” is any information which allows VIDIO to identify certain person or causes certain person to become identifiable based on the information itself or based on the combination with the other information (whether directly or indirectly), and other information related to the Personal by complying with the implementation of the prevailing law on data protection.
3.2. The collection of Users' Personal Data may be carried out by VIDIO by the following ways: (i) directly submitted by Users; (ii) automatically by systems related to the Services and the Platform; (iii) collected by VIDIO from other third parties which legitimately collected by them; and (iv) originating from other legitimate sources.
3.3. Personal Data which may be provided/submitted by the Users to VIDIO may include the name, username, password, e-mail address, mobile phone number, address and/or location, zip code, account verification, gender, age, photo, date of birth, payment and other information related to the transaction on Platform, including using of the services or User participation in the survey or marketing promotion, and the information when the Users choose the language and content preferences, account setting, game play data or other information through Platform.
3.4. Personal Data may include data collected automatically such as User's track record (log) which include but not limited to the device IP address, date and time of access, application feature, duration of websites viewed, application work process and other system activities, type of web browser, type of devices, type of operating system, device ID and/or site or service site of the third parties used before interacting with the site or Platform.
3.5. Personal Data collected from the third parties such as, including but not limited to: (i) TV or internet service providers, or other streaming media devices providers that make the services available on the User’s devices; (ii) mobile operators or other companies providing Services to the Users and collect the payments for Services to be distributed to VIDIO or providing the prepaid promotion for Services; and (iii) the voice assistant platform provider allowing the interaction with Services via voice commands. To avoid any doubt, the collection of Personal Data from this third party has received consent from the User to the third party concerned to collect, use and provide the Personal Data to other parties, in this case including VIDIO.
3.6. Personal Data and information from the other sources may cover:
Service providers which assist to determine the location based on User's IP address to adjust Services and other uses in accordance with this Privacy Policy.
Security service providers which provide us the information to secure Services, prevent the fraud, and help us to protect the security of VIDIO’s accounts.
The payment service providers which provide us the Payment Information or balance, or updates of such information, based on their relationship with the Users.
Online and offline data providers which provide VIDIO the aggregated, interest-based, and interest-related demographic data relating to the online advertisement; and
Publicly available sources such as publicly available posts on social media platforms and information made available through the public databases connecting IP addresses to Internet service providers (ISPs).
For avoidance of doubt, the collection of Personal Data from other sources has obtained consent from the User to the related party which ccollect, use and provide the Personal Data to other parties, in this case including VIDIO.
3.7. The User hereby declares that the Personal Data submitted by the User to VIDIO (including the documents uploaded and/or provided to VIDIO) are original, authentic, true, accurate, complete, not misleading, up to date, and constitute the personal right of the User and/or he has authority to submit the User’s personal data for submission into Services. In case the User submits the Personal Data of another individual, then this provision applies to that individual as represented by the User. Please refer to the provisions of Article 2.3. of Privacy Policy.
3.8. VIDIO protects all information provided by the User when the User uses all Services, including maintaining the confidentiality, integrity, and availability of the Personal Data it manages.
3.9. VIDIO shall be entitled from time to time to request for authentication and updating of the User's Personal Data, thereby the User’s data and information are accurate, complete, and up to date, including temporarily stopping the Service and/or terminating the permanent Service, in case the User does not yet authenticate and update the User's Personal Data and the User shall be entitled from time to time to update the User's Personal Data.
3.10. The User hereby understands that the process of authentication of Personal Data by the User is part of the User's Consent which is an explicit consent to the acquisition, storage, use, utilization, processing and/or disclosure of Personal Data submitted (inputted) by the User to Service and certain features in Platform, as well as declares that the provision of the use of such Personal Data is carried out without any duress, in competence, and consciousness condition.
4. PAYMENT OF AND INFORMATION ON BILLING
4.1. When the User purchases the subscription package or other things as provided in the Platform by using one or more of the payment gateway service providers,any online mobile payment service provider or including any application stores that VIDIO may use or cooperate with from time to time, the following payment information will be collected: details of credit/debit card (number, card expiry date, CVC code) or other bank account details together with the date, time and amount of transaction payment or equivalent information based on the payment method selected by the User. This Payment Information is stored by VIDIO's payment processor and associated to a User name/ID and the location provided with the payment processor to VIDIO, together with a unique customer ID provided by VIDIO to the payment processor and our payment processor uses this Payment Information to process and facilitate the payment of the User’s subscription fees in order that VIDIO is able to provide the Services requested by the Users to access the Platform (in other words to carry out the agreement). VIDIO and/or its payment processor will send the notification on successful transaction to the User, and it will be stored for internal accounting purposes. For certain Payment Methods, the Users shall comply with all terms and conditions of the third party’s payment gateway provider referred to the Platform and/or the third party’s platform, if referred to there. The Users’ acknowledge be bound by the terms and conditions on third party’s payment gateway and/or third party’s platform in accordance with the Payment Method used for the payment.
4.2. If the User pays the third party for the subscription package or other things (for example, an application store, digital wallet, telecommunication service provider) the Payment Information is directly collected and controlled by the third party. But, VIDIO may receive the invoice receipt from the third parties for the transaction carried out by the User and the receipt will be stored for VIDIO's internal accounting and taxes and to fulfill the obligations based on the prevailing law, audit, claim, legal process, agreement and/or investigation.
5. USE, STORAGE, UTILIZATION, PROCESSING, AND TRANSFER OF PERSONAL DATA
5.1. Related to the use of Personal Data, VIDIO:
5.1.1. shall be entitled to use the User’s Personal Data to improve the quality and service at VIDIO in accordance with the provisions in the prevailing legislation and based on the User’s Consent;
5.1.2. shall be entitled to use the general information and use of Services already collected for verification of User’s data;
5.1.3. shall be entitled to use the information on transaction to monitor and find out the User's transaction pattern, as well as for administration and investigation or other interests as required by the legislation;
5.1.4. shall be entitled to use and store the information on bank’s name including therein the name and account number, name and/or credit card number to ensure the payment/acceptance by VIDIO’s Users; and
5.1.5. shall be entitled to use the User's personal information entirely for know-your-customer (KYC), the internal data processing to ensure the service functions technically. The collected Users information and Personal Data can be used to comply with the prevailing legislation, investigation and dispute resolution, and other illegal activities, including if there is dispute with the third parties.
5.2. VIDIO shall be entitled to use, utilize, and disclose the User's Personal Data based on the User’s Consent that has been collected by VIDIO in any way to:
5.2.1. provide Services and/or third party’s offer, for example: (i) for the purposes related to the payment, billing, activation, provision, maintenance, support, problem solving, dispute resolution, deactivation, replacement, improvement or renewal of Service; (ii) to further understand, analyze, and predict the User’s preferences and interest, and combine the information with the other information to adjust the User’s experience; (iii) to ensure the Service functions technically as referred to above and to assist to identify and solve the problems; (iv) to facilitate the User’s access and the use of Services and/or the third party’s offer; (v) to send the subscription Offer, messages and posting in the Service on behalf of the channel administrator or official account; (vi) to combine the information with the information obtained from the other sources (including the third party’s offer) in relation to the provision of Service; (vii) to comply with or enforce the notification applicable to the Service; and/or (viii) to manage or respond to User’s question;
5.2.2. process, transfer, and/or store the Users’ data and information, both within and outside the territory of the Republic of Indonesia, always subject to the applicable law and regulations to Vidio;
5.2.3. develop the new Services and improve the existing Services and provide information to the Users about the third party’s content or relevant products, service and software including to communicate with the Users about various ways they use, including but not limited to to provide or send to the Users: (i) the improvement or update, or notification regarding upgrade or update, of the Services or third party’s content or relevant product, service and software; (ii) notification on upcoming promotion, contest, offer and event; and (iii) personal information, survey, marketing material, advertisement or adjusted content.
5.2.4. collect, use, and disclose for promotion and advertisement activities covering but not limited to the advertising identifier, including those provided by the other software Platform, or similar identifier, to facilitate VIDIO in carrying out the analytic or providing promotion content or other information that may be relevant to the Users;
5.2.5. manage and develop VIDIO's business and operation, including but not limited to: (i) to detect, monitor, investigate, reduce or prevent the fraud/piracy and technical or security issues or to protect asset and property of VIDIO; and/or (ii) to allow the business continuity and disaster recovery operation; (iii) to obtain the legal services, to seek for legal advice and/or to enforce VIDIO's legal right or the legal rights of other members of VIDIO; and/or (iv) for statistical purpose;
5.2.6. comply with the legal, including but not limited to when obliged and/or requested by the competent institution based on the prevailing law provisions, summon, official order of the Court, and/or official order of the relevant agency or apparatus, including but not limited to the dispute, investigatory, investigation, legal process and settlement process of disputes between VIDIO and the Users, between the Users, and the Users and the other parties as well as other illegal activities;
5.2.7. respond to emergency situations related to Users, including but not limited to provide the emergency assistance in situations that may threaten your or others' life or physical safety;
5.2.8. VIDIO's internal interest for business, product, quality, and service development including promotion, study, research activities, and VIDIO’s cooperation with the other third parties;
5.2.9. the interests of VIDIO, VIDIO’s affiliates, and group companies, for business, product, quality and service development including the promotion, study, research activities and VIDIO’s cooperation with the other third parties;
5.2.10. fulfill VIDIO's interest/obligations in transaction, including but not limited to in terms of sale of all or part of VIDIO's assets including any purchase, sale, lease, merger or amalgamation or acquisition, spin-off or financing or cooperation which entered by VIDIO, VIDIO’s affiliates, and group companies, with always subject to the provision hereunder;
5.2.11. provision of the Services and/or third party’s offers may be made by VIDIO itself or through the assistance of other third parties, including but not limited to: (i) payment service providers, (ii) information and technology service providers, (iii) customer service providers, (iv) marketing service providers, (v) legal and financial consultants, (vi) security service providers, and/or (vii) other service providers to carry out the above purposes whether existing or future;
5.2.12. fulfill the objective of Service, the objective of this Privacy Policy, the objective of the prevailing legislation and law in terms of data utilization and processing. In this case, VIDIO, VIDIO’s affiliates, group companies, covering VIDIO’s representatives, and other third parties entering into cooperation with VIDIO through the agreement and contain the binding confidentiality clauses; and/or
5.2.13. other objectives addressed from time to time by VIDIO to the Users, as well as permitted or required by the prevailing law and regulation to VIDIO.
5.3. The User is able to docertain control and choice regarding the collection, use and provision of his/her Personal Data, in accordance with the prevailing law, which are.:
5.3.1. Access to several User's Personal Data through the 'Profile' part on the Platform after successfully login. The User shall be responsible for providing accurate Personal Data to VIDIO and keeping the Personal Data up to date.
5.3.2. Ask us to correct or update the Personal Data about you that is inaccurate or incomplete by submitting e-mail to us available at Customer Support Vidio.
5.3.3. Ask us to delete your information and Personal Data when there is no reason for us to continue processing it by contacting us using the information provided at the end of this Privacy Policy, subject to the prevailing law and regulations.
5.4. VIDIO may store the User’s Personal Data as long as required to provide Service and in accordance with the lawful processing basis and to fulfill the legal obligations of the Republic of Indonesia. In addition to fulfilling the legal obligations of the Republic of Indonesia, VIDIO may also determine the period of retention of Personal Data for the following reasons:
5.4.1. Maintain the business records for analysis, tax and/or audit;
5.4.2. Comply with the requirements of legal notes saving;
5.4.3. Defend or file any existing or potential lawsuits;
5.4.4. Legitimate business objectives; and
5.4.5. Handle the complaints on Platform or any services available on the Platform.
5.5. The Users shall have the right pursuant to the law to decline the use of Personal Data in relation to certain types of processing, including the processing for direct marketing and profiling, the Users may file the objection by changing his/her preferences, turning off the cookies as described in the Cookies Policy or by contacting us. If the User desires to stop or limit the processing of Personal Data in relation to the personalized content or interest-based advertising, then the User may refuse to use cookies in accordance with the "Cookies Policy" in the General Terms. Rejection of cookies may result in important functions or features on the Platform.
5.6. VIDIO may transfer the User’s Personal Data to VIDIO’s affiliate platform or service providers or third party’s recipients to whom VIDIO provides the technology and hosting services, at the location for the objective explained in this Privacy Policy. Therefore, by approving this Privacy Policy, the User shall also approve to transfer the Personal Data and Data to VIDIO’s affiliate platform or service providers or third party recipient at such location designated or cooperated with by VIDIO from time to time. Wherever the User’s Personal Data is transferred, stored or processed by VIDIO or VIDIO's affiliate platform or service providers, VIDIO will take any reasonable measures to protect the privacy of the User’s Personal Data.
6. DISCLOSURE
6.1. With the User’s Consent, VIDIO shall be entitled to disclose the User’s Personal Data as follows:
For the marketing, analytic, research, communication, advertisement, IT infrastructure and service, technology or software providers, payment processing, User assistance service and other services in cooperation with VIDIO or assisting VIDIO to provide services to the Users or provide software permit to VIDIO included in VIDIO’s application(s) to provide, support or improve Services and allow VIDIO to analyze Service and marketing programs.
For cooperation, promotion or joint program that will require VIDIO to share the User’s information with the third parties in enhancing the User’s participation.
For the purposes of implementing agreements made by VIDIO with other third parties, always subject to the provisions of applicable laws and regulations.
If there is processing of Personal Data, transfer of local and interstate data.
If VIDIO is reasonably sure that such disclosure is required to: (i) fulfill any prevailing request of the law, regulation, legal process or government, (ii) enforce the prevailing provisions on use, including investigation to potential breach therein, (iii) detect, prevent, or handle the illegal activities or suspected illegal activities (including fraudulent payment), security issues or technical issues, or (iv) protect the right, property or safety of VIDIO, Platform users, or the public from any losses as required or permitted by the law.
If there is business transfer, such as merger or acquisition by the other company or in case of business reorganization or restructuring. In case of a business transfer, the notification related to the disclosure of Personal Data made by VIDIO is given with the notification of the plan and result of the business transfer.
6.2. In disclosing the information:
a. VIDIO may disclose several User’s Personal Data thereby the information becomes the information that cannot identify the User entirely (aggregate/anonymous data) addressed to the third parties used for the application development, database management, analysis or service improvement, promotion and advertisement; and
b. VIDIO may also combine the User’s Personal Dataand the other information in such a way thereby the information is no longer associated to the User, then discloses the combined information to third parties.

7. USER’S RIGHT TO PERSONAL DATA
7.1. In processing Personal Data by VIDIO under this Privacy Policy, User may have certain rights pursuant to the prevailing law, such as updating, obtaining access to or copies of, terminating the processing of, and/or withdrawing User's Consent to the Personal Data.
7.2. The User will be able to exercise his/her rights based on the prevailing law by contacting VIDIO via e-mail using the information provided at the end of this Privacy Policy. VIDIO may refuse User's request if authorized or for the reasons provided by the prevailing law.
8. LIMITATION OF VIDIO'S RESPONSIBILITY
8.1. The User shall be responsible for security and breach mitigation of VIDIO’s account of the User itself, such as applying the appropriate security, restricting the access, creating the strong password, maintaining password, maintaining one-time password (OTP).
8.2. VIDIO shall not be responsible for the exchange and provision of the Users’ personal data and information carried out by the Users themselves, including those carried out between the Users. This provision shall include any and all User’s negligence resulting in the User’s data leakage.
8.3. By issuing the User’s Consent, the User waives the rights to claim, loss, demand and suit potentially occurring for acquisition, storage, use, utilization and/or disclosure of data, including the personal data, in Service.
8.4. In case the User is a minor, VIDIO shall not be responsible for the input of the child User’s personal data and recommends that the parent/guardian of the child monitors the child's internet usage, thereby the provision of the child User's personal data is provided and/or under the supervision of the parent/guardian as the competent party.
8.5. VIDIO shall not be responsible for any data leakage occurring as the consequence of and/or occurring during the Force Majeure. The Force Majeure shall cover, inter alia: (i) strike, company disclosure and other industrial acts; (ii) riot, insurrection, invasion, terrorist attack or threat, war (whether declared or not) or threat of war preparation; (iii) fire, explosion, storm, flood, earthquake, epidemic or other natural disaster; (iv) unavailability or disruption of telecommunication, informatics and/or electricity networks; (v) there is Service failure caused by the third party occurring beyond VIDIO's authority; (vi) malfunction of the banking system and/or network, (vii) act, judgment, law, regulation or restriction issued by the government. In case of Force Majeure, VIDIO will notify the User upon the occurrence of the Force Majeure and carry out commercially reasonable action to fulfill VIDIO's obligations based on this Privacy Policy.
9. SECURITY
9.1. VIDIO will continuously apply and update the administrative, technical and physical security measures to assist to protect the User’s Personal Data from unauthorized access, loss, damage or alteration. There are several protections we use to protect the User’s Personal Data such as firewall and data encryption, and information access control. These measures are designed to provide the level of security appropriate to the risks in processing the User’s Personal Data. If the User knows or has reason to believe that the User’s account credential has been lost, stolen, altered or compromised or in case of unauthorized use or suspected unauthorized use of the User's account, please contact VIDIO (see the information below).
9.2. VIDIO uses commercially reasonable industry standard security practices and procedures designed to help to protect the User’s Personal Data in order to be safe and secure. But, there are no perfect or impenetrable security measures, VIDIO cannot guarantee the data security since every transmission is the User’s risk. VIDIO will always do its best to protect the User’s Personal Data and ensure on reasonable basis that every person employed by VIDIO complies with the security standard thereby the protection of the User’s Personal Data is always maintained.
10. ACCOUNT DELETION
10.1. iOS device users
iOS device users who need to delete their account can do it by themselves by clicking the “Delete Account” menu on the Vidio app. Users of other devices can contact info@vidio.com to get assistance in the account deletion process.
10.2. Users who have auto-renewing subscriptions
For Users who have an auto-renewing VIDIO subscription plan, here are the following steps for account deletion:
Login to your VIDIO account and go to the Accounts and Settings page.
Select Settings > Accounts menu.
On the Account Settings page, select Delete Account. To delete an account, you will be asked to cancel your plan subscription first. Click the Manage Subscriptions button.
Cancel subscription in the My Plans menu.
Tell us why you're deleting the account on the Account Deletion Confirmation page.
Click the Delete Account button, and the User account will be deleted by the system.
10.3. Users who do not subscribe or have a plan that does not auto-renew
For Users who do not have a subscription plan or have a subscription plan but it is not automatically renewed, here are the steps for account deletion:
Login to your Vidio account and go to the Accounts and Settings page.
Select Settings > Account menu.
On the Account Settings page, select Delete Account.
Click the Delete Account button to proceed with deleting your account.
The User Account will be deleted by the system.
10.4. Implications of Account Deletion
10.4.1. The User will lose the benefits as a User, including but not limited to:
Deletion is permanent, so Users cannot reactivate or recover the same account;
All Users’ profile data, such as User activity and viewing history, is permanently deleted;
All such VIDIO subscription plans will become invalid, even if the payment has been paid in full and the validity period of the subscription plan still exists;
Users arenot able to use “Energy”, “Ticket” and/or other things (as modified, replaced or available from time to time) related to the gamification features on the Platform; and
Unredeemed and undelivered referral rewards.
10.4.2. For users who subscribe to the Vidio plan using the Apple Pay payment method, the subscription must be canceled first in Apple settings in order to delete the Vidio account.
11. CHANGE OF PRIVACY POLICY
This Privacy Policy may be subjected to change from time to time. VIDIO shall be entitled to update this Privacy Policy to keep it relevant and up to date with the change of technology, the prevailing law, evolving business practice and/or the User’s needs. VIDIO will provide the most recent update date, if any changes are made to this Privacy Policy. VIDIO may inform if there is any update on this Privacy Policy in accordance with VIDIO sole discretion. VIDIO encourage the Users to periodically review this Privacy Policy in order to remain informed about how VIDIO processyour personal data and information. By continuing to use or access the Service or communicating with Vidio after the changes to this Privacy Policy is made and the User does not withdraw the User Consent, as long as it is not prohibited by the applicable law, the User is considered to give the User’s Consent to the Privacy Policy including any of its amendment. If the User does not agree to the updates or changes to the Privacy Policy, the User may stop using the Service by canceling the subscription or deleting the User account.
12. ACCOUNT INFORMATION
You can edit your profile info on the Profile page. Changes to your e-mail and mobile number should be made in the Account Setting menu. To delete your account, please contact info@vidio.com or follow the steps as provided herein.
13. LANGUAGE
This Privacy Policy is provided in two languages, namely English and Indonesian. If there is a discrepancy between the English version and the Indonesian version, the Indonesian version will apply, and the English version will be deemed to have been automatically changed to conform to the Indonesian version of this Privacy Policy

VIDIO complies with all prevailing legislation and the government policy of the Republic of Indonesia, including those regulating the electronic information and transaction, electronic system provision, and protection of User’s personal data; including all implementing regulations and amendments to the regulations regulating and protecting the use of important data and information for the Users.
